The Ordinary Court Martial of Private (Pte) Shane Coulthrust commenced today, Monday 19 April 2021 in the Hodgson Hall Conference Room, St Ann’s Fort, Garrison St Michael. Pte Coulthrust is represented by Attorney-at-law, Andrew Pilgrim Q.C

The Court heard opening remarks from Prosecutor Captain Neville Corbin, who set about to paint a picture of what the evidence presented will reveal. The Prosecution likened the road map of evidence to the notion that “you cannot run with the hares and hunt with the hounds”.

Chief Petty Officer Arlington Cadogan, Lieutenant Coast Guard Sena Price, Leading Seaman Ian Mitchel, Petty Officer Nicole Brathwaite and Sub-Lieutenant Alexander Kellman, presented witness evidence in the case.

The Court Martial will resume on Tuesday 20 April 2021 at 9AM.

The Charges:

  1. CONDUCT TO PREJUDICE OF GOOD ORDER AND MILITARY DISCIPLINE CONTRARY TO SECTION 75 OF THE DEFENCE ACT CAP 159, in that he, while on duty as the coxswain on board BCG vessel ENDURANCE on the 19 April 2019, collected 14 polythene packages, placed them on the ENDURANCE a vessel owned by the crown without authorisation from any of his superior officers.

 

  1. CONDUCT TO PREJUDICE OF GOOD ORDER AND MILITARY DISCIPLINE CONTRARY TO SECTION 75 OF THE DEFENCE ACT CAP 159, in that he, while on duty as the coxswain on board BCG vessel ENDURANCE on the 19 April 2019, transported 14 polythene packages to the Six Men’s St Peter area without authorisation from any of his superior officers.

 

  1. CONDUCT TO PREJUDICE OF GOOD ORDER AND MILITARY DISCIPLINE CONTRARY TO SECTION 75 OF THE DEFENCE ACT CAP 159, in that he, while on duty as the coxswain on board BCG vessel ENDURANCE on the 19 April 2019, transferred 14 polythene packages to the Fishing Vessel X17 which was moored in Six Men’s St Peter area without authorisation from any of his superior officers.

 

  1. CONDUCT TO PREJUDICE OF GOOD ORDER AND MILITARY DISCIPLINE CONTRARY TO SECTION 75 OF THE DEFENCE ACT CAP 159, in that he, while on duty as the coxswain on board BCG vessel ENDURANCE on the 19 April 2019, coopered with an unknown speed boat in the territorial waters of Barbados without authorisation from any of his superior officers.

 

  1. CONDUCT TO PREJUDICE OF GOOD ORDER AND MILITARY DISCIPLINE CONTRARY TO SECTION 75 OF THE DEFENCE ACT CAP 159.
  1. DISOBEDIENCE TO STANDING ORDERS CONTRARY TO SECTION 47 OF THE DEFENCE ACT CAP 159, in that he on 19 April 2019, contravened Sec 1709.4 of the Barbados Coast Guard Standing Orders, an order known to him or which is reasonably expected that he should have known by using his personal cellular phone on board the ENDURANCE while on patrol on the 19 April 2019.
  1. DISOBEDIENCE TO PARTICULAR ORDERS CONTRARY TO SECTION 45 (1) OF THE DEFENCE ACT CAP 159, in that he, on 19 April 2019, being the coxswain of the ENDURANCE, deviated without lawful authority, from his patrol area in accordance with SBF Patrol Orders dated 19 April 2019.
  1. CONDUCT TO PREJUDICE OF GOOD ORDER AND MILITARY DISCIPLINE CONTRARY TO SECTION 75 OF THE DEFENCE ACT CAP 159.

MAKING A FALSE DOCUMENT CONTRARY TO SECTION 69 (C) OF THE DEFENCE ACT CAP 159, in that he being the coxswain of the SBF Crew on 19 April 2019, made a written report on 20 April 2019, to with his Patrol Report, with intent to deceive, failed to accurately account for all details of his patrol on 19 April 2019 while on board BCG vessel EDURANCE in the Territorial Waters of Barbados.

 

  1. CONDUCT TO PREJUDICE OF GOOD ORDER AND MILITARY DISCIPLINE CONTRARY TO SECTION 75 OF THE DEFENCE ACT CAP 159.
